Customer: the person identified by the data entered when completing and sending the order form with simultaneous acceptance of these general conditions. It is strictly forbidden for the buyer to enter false and / or invented and / or fictional data in the online ordering procedure and in further communications. The Supplier reserves the right to legally pursue any violation and abuse, in the interest and for the protection of all consumers. Furthermore, the Customer releases the Supplier from any liability deriving from the issue of incorrect tax documents due to errors relating to the data provided by the Customer, since the Customer himself is solely responsible for the correct insertion.

Through the e-commerce service, the Supplier provides the Customer with a virtual shelf from which it is possible to view and purchase the highlighted goods online. The items sold above are illustrated on the pages of the site https://configuratore.sartelli.com. Each item is accompanied by a sheet indicating its main characteristics in brief and the technical specifications. The Customer can view the electronic catalog and the offers of the Supplier and can freely make purchases from the Supplier by accepting these conditions of sale, which will be applied to sales both in Italy and abroad. By “online” sales contract we mean the distance contract, that is the legal transaction concerning movable property and / or services stipulated between the Supplier and the Customer in the context of a remote sales system organized by the Supplier which , for this contract, it uses the distance communication technology called “Internet”. These contracts, therefore, will be concluded directly through the access by the Customer to the website corresponding to the address https://configuratore.sartelli.com, where, following the indicated procedures, he will conclude the contract for the purchase of the well.

Unless otherwise indicated in writing, all prices indicated are “VAT included”. The validity of the prices indicated is always and only that indicated by the procedure (order form) at the moment of placing the order to the Supplier. The prices of the products may in fact vary without the need for any notice. The prices indicated do not include transport costs. The final price is made up of the price of the product, including VAT and logistics costs. Any customs fees are charged to the seller.

When ordering, it is possible to choose whether to pay by credit card through the PayPal circuit, suitable for ensuring the confidentiality of the data provided by customers, or through a Paypal account.

Payment by credit card . In case of payment by credit card, the Customer is automatically redirected to the PayPal payment manager page. Therefore, it is possible to pay by credit card even if you do not have a Paypal account.
Credit card information and data (card number, holder, expiration date, security code) are encrypted and transmitted directly to the PayPal payment manager.
AGK ITALIA Srl does not memorize, archive and does not process credit card data.

Payment with PayPal system . If the Customer chooses to pay with the PayPal system, he will be redirected to the specific site where he will authorize PayPal to proceed with the payment according to the procedure and terms provided by PayPal, whose data will be processed directly by the same and not transmitted or shared with AGK ITALIA Srl, which therefore does not store any data of the card linked to the PayPal account. The data relating to the Order are transmitted encrypted according to the SSL (Secur Socket Layer) system directly on the PayPal servers which guarantee the security of data transmission according to the regulations in force.

Shipments, unless otherwise agreed, will take place by means of our affiliated couriers with charge of the cost incurred on the invoice.

Delivery times are at least 5 working days for Italy and the EU from the order and within 8 days for all other destinations and vary according to the type of product chosen. The buyer is not allowed to refuse the goods or ask for compensation in case of delay in delivery or shipment.

Given the health emergency in Italy, it is not possible to guarantee the delivery of orders according to the normally scheduled times. Delivery times may be delayed in the case of holidays; carriers do not deliver on 12/25, 12/26, 01/01 and weekends. For orders placed by credit card, at the normal times, it is necessary to add one working day for normal administrative checks. For orders placed by bank transfer, the shipping times will be calculated starting from the confirmation of payment.

The right of withdrawal is governed by Legislative Decree n. 206 of 06/09/2005. If the customer is a private individual (i.e. a natural person who does not make the purchase by indicating a VAT number in the order form) he has the right to withdraw from the purchase contract for any reason (SATISFIED OR MONEY BACK).

The right of withdrawal is however subject to the following conditions:

– any shipping costs paid for sending the goods in the first place will be refunded together with the amount paid for the purchase of the goods if the reason for the return depends on a defective garment.

– the shipment, up to the certificate of receipt in our warehouse, is under the complete responsibility of the Customer; in the event of damage to the goods during transport, the supplier will notify the Customer of the incident (within 5 working days of receipt of the goods in their warehouses), to allow him to promptly file a complaint against the courier and obtain a refund of the value of the good (if insured); in this case, the product will be made available to the Customer for its return, at the same time canceling the request for withdrawal;

– AGK ITALIA Srl is not responsible in any way for damage or theft / loss of goods returned by uninsured shipments.

When the right of withdrawal expires

The right of withdrawal is totally lost, for lack of the essential condition of integrity of the property (packaging and / or its contents), in cases where it is ascertained:

– even partial use of the asset;
– the lack of the external packaging and / or the original internal packaging;
– damage to the product for any cause;
– the absence of integral elements of the product (accessories, parts, etc.);
– in the cases indicated above, it will return the purchased good to the sender, charging the shipping costs to the sender;
– Customers who purchase with a VAT number cannot exercise the right of withdrawal.

You have 5 days from receipt of the package to make the return.

Only intact and unused items will be accepted.

The refund is activated as quickly as possible and in any case within fourteen (14) days from the date on which the goods are received at the returned warehouse, after checking the returned products.

The refund is issued on the payment method used for the purchase.

The return must be made through the same shipper who made the delivery (DHL or BARTOLINI), using the same integral receipt package with the words “to be paid by the recipient”.

When the refund is made, the Seller will withhold from the same a fixed rate equal to the shipping costs incurred for the return of the item.
For international shipments, not only the transport costs but also the customs charges incurred for the return of the goods to Italy will be deducted from the refund amount.

8. Acceptance of the General Contract Conditions

9. Jurisdiction and Competent Court

Any dispute relating to purchase contracts stipulated through the site https://www.sartelli.com is subject exclusively to the law of the Italian State. The combined provisions of Legislative Decree n. 50/1992 and of Legislative Decree n. 185/1999. For any dispute between the parties regarding this contract, the Court of the place of the buyer’s domicile will be exclusively competent, if located in the Italian territory. If the buyer’s domicile and residence are not within the Italian territory, the competent court will be that of Santa Maria Capua Vetere.
